What is the Convention?

  • International Convention on the rights of persons with disabilities (8th International convention);
  • Human rights are inter-related, integral and comprehensive;
  • International human rights instrument;
  • A None-discrimination convention and equalization of opportunities (Equality)

Ratification/signing of the Convention

National implementation: a key to success:

Legislation < Policy < Project

  • Review of existing legal framework and sectoral laws, in line with the Convention;
  • Revision and formulation of effective legislation, including anti-discrimination law on disability (Australia, USA, UK, Hong Kong-China, etc.) and its national enforcement mechanism (e.g. EOC, Hong Kong) and other legal provisions (e.g. building code, etc.);
  • Review and revision of national and local (e.g. prefecture and/or municipality based) action plans on disability (as follow up to the Convention);
  • Project (e.g. APDC, leadership training, CBR, etc.) and disability mainstreaming into generic evelopment projects ---- international cooperation
  • Proactive action such as advocacy and public awareness raising (of disability rights);
  • Establishment of an effective national monitoring mechanism, with participation of PWD, to be supplemented by the NGO Forum (NGO networking, shadow report);
  • Execution of operational projects (including national execution and TC) for benefit of PWD: Twin-Track approach of disability specific project (e.g. APDC, leadership training, CBR, etc.) and disability mainstreaming into generic evelopment projects ---- international cooperation and national responsibility (national ownership)

The agenda and purpose of this workshop

  • Agenda
  1. The latest status of the process towards an International Convention (report from 6th and 7th session);
  2. Questions about International monitoring
  3. Forward- looking strategies (including ratification, signing, monitoring and implementation);
  4. The alignment effects of the Convention, the BMF, and domestic legislation such as national anti discrimination law on disability, rights-based national policy on disability, regulations, etc.

Contentious and outstanding issues

  • Entered the stage of finalizing the Convention Text;
  • To be concluded at 8th session or 9th session, for endorsement of UN GA in Fall 2007?
  • Several contentious and outstanding issues: International monitoring mechanism, legal capacity, international cooperation, disabled women, etc.

Outcomes of this workshop

  • Participants will be informed of the latest status of the AHC and the convention for formulating a better strategy for negotiation;
  • Momentum for ratification and signing;
  • Strategies for national efforts (legislation reform, national policy review, networking, projects, etc.)
  • Adoption of the joint statement as a Group at the end of the workshop

What is the immediate follow up to this Workshop?

  • The Joint Statement and our views will be shared widely with audiences from outside our region, during the ESCAP side event of the 8th session of AHC in August, in NY;
  • Follow- up ESCAP workshops, for more concrete national strategies for implementation in 2007;
  • Inputs to the 2007 mid-point review and the new set of strategies (BMF plus 5)
