Expert Group Meeting and Seminar on an International Convention to Protect and Promote the Rights and Dignity of Persons with Disabilities
Bangkok, Thailand, 2-4 June 2003

Outcome: Bangkok Recommendations, submitted to the Second Session of Ad-Hoc Committee on the Convention, held in NY, 16-27 2003 by UN ESCAP.

By the 2nd session of the Ad Hoc Committee, a working group to prepare the draft text of Convention was adopted.

There are a lot of challenges and long term steps ahead of us.

Critical points of the 4th and 5th session

  1. Nothing about us without us;
  2. Progressive realization of socio-economic rights;
  3. Social model against medical model;
  4. Elimination of state parties obligations in relation to remedies (unlike the Bangkok Draft:
  5. Disability Data collection
  6. EU (non-discrimination) vs comprehensive model;
  7. Definition of reasonable accommodation;
  8. RI: need for a separate article about rehabilitation;
  9. Right to choose inclusive education, with alternative education option available (for the deaf, the blind, etc.);
  10. International cooperation;
  11. New rights, such as accessibility rights, reasonable accommodation.

Future strategy:

  • Dialogue between NGO communities and the government;
  • Civil Society Lobbying:
  • Closed informal consultations in the Ad Hoc Committee;
  • In each country’s context.

Each country context

  • Lobbying with the Government if possible in a given country (country A, country B)?;
  • Implementation and realization of civil political, and socio-economic rights:
  • Disability Discrimination Ordinance (No. 86 of 1995) --- good practice of rights-based legislative in the region, together with Disability Discrimination Act (1992) of Australia and Magna Carta for Disabled Persons (Republic Act. No 7277) of the Philippines. Is regional replication and exchange of good practice possible?

Preparations for the forthcoming 6th session of AHC, 1-12 August 2005 in New York

  • Continuation of revisions of the Convention text;
  • Negotiations among different governments, from both developed and developing countries;
  • UN ESCAP hosted side event, the round table on disability inclusive technical cooperation projects, 11 August 2005;
  • More emphasis on “implementation of the Convention by State Parties and other entities;
  • Issue of disability inclusive technical cooperation in the Asia-Pacific region.

Agenda of this workshop

  • Participation of DPOs and NGOs in the process towards the Convention and at AHC sessions (e.g. representation of persons with disabilities and DPOs/NGOs in a national delegation team, national negotiations and dialogue prior to each AHC session, etc.);
  • Establishment of an effective monitoring mechanism at the national level (e.g. revitalization of national human rights commission, establishment of equal opportunity commission, the role of national coordination mechanism, etc.);
  • Towards development of an anti-discrimination law in countries of the ESCAP region (some good practices in the ESCAP region);
  • Disability inclusive international and regional cooperation (Twin track approach, disability integrated technical cooperation, disability impact assessment, etc.);
  • Towards ratification of the Convention.

At the end of workshop

  • We do hope to consider adoption of a joint statement on the agenda item;
  • Our group’s vision on disability inclusive technical cooperation;
  • What ESCAP should do in the process in the near future, within the same limited resources;
  • Guidelines for the proposed ESCAP sponsored side event during the 6th session.
