1. Vision
- Government’s vision in planning disability related laws, policies and
plans.
Our Government’s vision in planning disability related laws, policies
and plans based on the National Plan of Action for Indonesians’ PWDs are
Independence, equality in order to achieve the welfare for PWDs in 2013.
- Values and concepts.
The important values and concepts are equality, provision
accessibility and adherence to the International Instruments and
implementation of the BMF program actions.
- Twin Tract Approach.
Twin track approach are very important to broaden the effort for
empowerment. One side we need special laws in order community realized that
PWDs. are exist and they need equal opportunity to obtain training and
employment. The other side we need disability inclusive laws, by this
law there is no discrimination, each public facilities must be provide
accessibilities for PWDs. So by twin track approach the quality and
the coverage of social rehabilitation and services for PWDs increasing.
2. Issues in application of twin-track approaches
- Specific advantages and disadvantages in applying twin-track approach.
Advantages:
- Both type of laws,
policy and planning can be implemented together and indeed both of them are
able to support each other.
For example:
When we discuss about the provision of accessibility for PWDs based on
the article on specific disability laws, then to implement this article then
the disability –inclusive laws such as the law no: 28 re: Building Code
should also be as a reference on how to build as well as on how to provide
the accessibility for the PWDs.
- Number of PWDs
involve in PWDs empowerment is increased, due to the clarification of job
and responsibility of each parties involved in enhancement the welfare of
PWDs
Disadvantages:
- Based on the
implementation of both types of laws, the disadvantages of applying those
laws are that there is difference interpretation of articles on both laws
that cause differences implementation
- The human resources
is not ready yet therefore it needs a bigger personnel as well as finance
- Other relevant issues.
Mainstreaming of PWDs should be side by side with the development of
specific laws of PWDs. If not PWDs will have to face the problems related to
the opportunity due to the disability they have. Right now in Indonesia
still applies both types of laws
3. Analysis, planning and programming from the disability
perspective
- Government analysis of PWDs?
By gathering and discussing the information from variety government
institution, NGOs for and of PWDs through meeting with the team of Social
Welfare Enhancement for PWDs
- Government gather disability-aggregated data and socioeconomic
indicator.
Yes, by doing survey and research based on the needs of each
institution (both Government
Institution and NGOs of and for PWDs as well).
- Government’s policy framework/structure for disability issues.
The equality of rights and responsibility, equal opportunity to have
the access of work as well as the appropriate life of PWDs, empowerment as
well as the accessibility for PWDs
4. Participation and Institutional Arrangement
- National Level:
Government includes participation stakeholder by involving the
representatives from the related Government institution, NGOs for and of
PWDs, Academics, Private Sectors, National Chambers of trade and Industry (KADIN),
Association of Indonesians’ Entrepreneurs APINDO as a member of the team of
Social Welfare Enhancement for PWDs to discuss issues related disabilities.
- Regional:
Development the Center of Information and Services on Vocational
Rehabilitation for PWDs, and establishment of Networking of PWDs empowerment
5. Resources mobilization
- Government finance the
implementation monitoring / evaluation of policies, laws and plans.
Each Government institution that concern of the welfare for PWDs has
own budget for monitoring / evaluation of policies, laws and plans. Special
for the Team of Social Welfare Enhancement for PWDs, Ministry of Social
Affairs finance the implementation monitoring / evaluation of policies, laws
and plans
- Government obtain ideas and
knowledge and technology, necessary for the planning, implementation and
monitoring/evaluation of policies, laws, and plans.
- Through the meeting
of team Social Welfare Enhancement for PWDs, PWDs, the NGOs for and of PWDs
as well as visit to the NGOs concern of PWDs
- Each institution
(both Government institution and NGOs) has allocated and implemented the
activities as the task and responsibilities of its institution.
- Government/Ministry
obtain political support for the planning, implementation and
monitoring/evaluation of policies, laws and plans.
- Generally, PWDs and
or NGOs for and of PWDs have made a petition and or declaration regarding
their support to the Government on planning, implementing as well as
monitoring/evaluation policies, laws and plans
- Socialization of
Laws no: 4 /1997 regarding People with Disabilities through Mass Media as
well as the Budget of the House of Representatives.
- Government mobilize necessary
material and human resources.
- Conducting training
for PWDs or training for officials who works for PWDs either in the
Government Institution or NGOs
- Developing /
formulating the material needed with involving resources persons such as,
academics, government institution, PWDs as well as NGOs.
- Coordination with
International Agencies, In country agencies as well as foreign agencies
6. Setting time-frames, and issues in implementation management.
- Timeframe for the planning, implementation and monitoring/evaluation
of policies, laws and plans.
Usually planning has been done a year or 2 years before implementation
policies laws and plans, implementation has been done during a period of
time ( 1 – 5 years) and evaluation has been done during that time and after.
- Other management issues.
- Coordination among agencies, institution, as well as NGOs
concerns of the PWDs empowerment not yet running well. It is due to the all
parties do not understand the meaning of PWDs empowerment.
- There is a stigma that
PWDs do not need to be empowered. It is due to the community who do not have
the disability are unemployment, or they are fired of their work, etc.
7. Monitoring and Evaluation
- Government’s system for monitoring and evaluation of policies, laws
and plans.
Our monitoring and
evaluation system of policies, laws and plans is implemented in both types
(bottom up and top down) which meant if the bottom up system report comes
from the grassroots level, District, Municipal, Province and last
headquarters. Meanwhile if the top down system, report comes from the
headquarters (National Level) result of their tour of duty to the province,
district, or NGOs that implement those policies, laws and plans.
8. Reporting and public information.
- How does your Government report on the monitoring and the evaluation?
Usually, Government reports on the monitoring and evaluation trough
the meeting of the Team of Social Welfare Enhancement for PWDs, or those
reports have been discussed through the Ministerial Meeting under
coordination of Coordinator Ministry of People Welfare.
- Government raise awareness on disability-sensitive society.
- Publishing the
magazines, booklet, leaflet regarding the needs, activity as well as
services for PWDs,
- Conducting seminars,
workshops,
- Interactive dialog
through Electronic Media
- Training for community
and
- Provision accessibility
for PWDs
- Socializing the needs
of PWDs, services provided by the Government Institution as well as NGOs and
the important meaning of accessibility for PWDs, profiles of PWDs who
successes run their business through printed media as well as
electronic media.
